Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services provided by RedWEYL ("RedWEYL," "we," "us," or "our"), including redweyl.com and our products such as Vytalai (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Who we are

RedWEYL is a software studio that builds its own AI-powered applications and develops custom software for clients and enterprises. These Terms apply to all RedWEYL Services unless a specific product presents its own separate terms, in which case those additional terms also apply.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use paid Services. If you are under that age, you may use the Services only with the involvement and consent of a parent or legal guardian. By using the Services, you represent that you meet these requirements.

3. Accounts & registration

To use certain features you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@redweyl.com if you suspect unauthorized use.

4. Subscriptions, plans & billing

Some Services are offered free of charge and others require a paid subscription. Current plans and prices, including Vytalai's Free, Client Pro, Trainer Pro, and Trainer Elite tiers, are shown on the relevant product page. Unless stated otherwise:

• Paid plans are billed in advance on a recurring monthly basis and renew automatically until cancelled.
• Prices are stated in US dollars and may exclude applicable taxes, which may be added at checkout.
• Payments are processed by a third-party payment processor; by subscribing you also agree to that processor's terms. We do not store full payment card details.
• We may change plan features or prices; we will give reasonable advance notice of price changes, which take effect on your next billing cycle.

5. Cancellations & refunds

You may cancel a paid subscription at any time from your account settings. Cancellation stops future renewals; your plan remains active until the end of the current billing period. Refunds are handled as described in our Refund & Cancellation Policy, which forms part of these Terms.

6. Health & fitness disclaimer

Vytalai and other RedWEYL fitness or wellness Services provide general fitness, exercise, and nutrition information and AI-generated guidance for informational purposes only. They are not medical advice and are not a substitute for professional medical care, diagnosis, or treatment. Consult a qualified healthcare provider before beginning any exercise or nutrition program, especially if you have a medical condition, are pregnant, or are taking medication. You participate in physical activity at your own risk, and you assume full responsibility for any resulting injury or harm to the fullest extent permitted by law.

7. Acceptable use

You agree not to misuse the Services. You will not: use the Services for unlawful purposes; attempt to gain unauthorized access to our systems; interfere with or disrupt the Services; reverse engineer, copy, or resell any part of the Services except as permitted by law; or upload content that is illegal, infringing, or harmful. We may suspend or terminate access for violations.

8. Your content

You retain ownership of the content and data you submit to the Services. You grant RedWEYL a limited, worldwide, non-exclusive license to host, process, and use that content solely to operate, provide, and improve the Services. You are responsible for ensuring you have the rights to any content you submit.

9. Intellectual property

The Services, including all software, design, text, graphics, and the RedWEYL and Vytalai names and logos, are owned by RedWEYL or its licensors and are protected by intellectual property laws. We grant you a limited, non-transferable, revocable license to use the Services for their intended purpose. No other rights are granted.

10. Third-party services

The Services may link to or rely on third-party services, including app stores and payment processors. We are not responsible for third-party content or practices, and your use of them is governed by their own terms and policies.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

12. Limitation of liability

To the maximum extent permitted by law, RedWEYL and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold RedWEYL harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Services, to the extent permitted by applicable law.

14. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive termination will remain in effect.

15. Governing law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which RedWEYL is established, without regard to its conflict-of-law principles. Nothing in these Terms limits any mandatory consumer rights you may have under the laws of your country of residence.

16. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
